This Agreement for Use ("Agreement") is entered into and effective on

by and between GFWC Woman's Club of Homestead, Florida, Inc. a Florida not for profit corporation, herein after referred to as"Owner"and

In consideration of mutual promises contained herein and other good and valuable consideration, "Owner" agrees to allow "USER" to utilize the building and property, at 17905 SW 292 St, Homestead, Florida 33030 herein after referred to as “PROPERTY” upon the following terms and conditions.

Payment Schedule:

½ of total due with application, plus security deposit and applicable cleaning fee. (SECURITY DEPOSIT is non-refundable if cancelled within 14 days of event):

USER agrees that its use of the Property shall be subject to the following rules

hours. Two (2) hour minimum Contracted hours includes clean up time for the event. USER must begin in a timely manner to clean the premises; which must be completely vacated by the end of the final rental hour. Speak to Club Manager for set up time.

B.     NO SMOKING SHALL BE ALLOWED INSIDE THE PROPERTY, INCLUDING ANY VAPORING DEVICE.

D.   No music shall be played outside the building or in such a manner that it can be heard beyond the boundaries of the building. All DJ’s, bands must use electricity supplied by the PROPERTY, no generators or other power generating equipment may be used. NO SMOKE OR FOG MACHINES MAY BE USED INSIDE THE PROPERTY.

E.    No decorations, displays or any other items shall be affixed to either the interior or exterior of the building in any manner. The use of candles or flames of any kind (Including momentary use for cake decorations) shall be drip-less and contained within a globe or cover.

F.    The use of OWNERS tables and chair are included in rental. Set up of tables and chairs is the responsibility of the USER

G.   No table or chairs are to be removed from the building.

H.  Kitchen Facilities: The kitchen may only be used for heating or cold storage of food and beverages. NO COOKING is permitted under this agreement UNLESS KITCHEN RENTAL IS ADDED TO RENTAL AGREEMENT. All food and beverages must be removed at the end of the rental period.

I.    Supplies: USER is to supply all necessary serving utensils, plates, flatware, napkins, cups etc. for their event.

J.    Parking shall be permitted in designated areas within the fenced grass area.

K.    The building and grounds shall be left clean, free of debris and litter. Trash bags and receptacles will be provided, upon the conclusion of rental period, USER shall place all trash securely tied in the dumpster.

L.    No more than 146 people shall be in the building at the same time.

M.   NO DIRECT SALE OF ALCOHOL SHALL BE PERMITTED OR ANY OTHER ACTIVITY CONTRARY TO THE LAWS OF MIAMI-DADE COUNTY OR THE STATE OF FLORIDA.

N.   Returned or NSF check charge is $50.00.

O.   A representative of the OWNER shall be present at all events. All rules must be adhered to.

P.   Upon inspection of the PROPERTY, with a determination that there has been compliance with terms and condition hereof and there has been no damage to property, the security deposit shall be returned to the USER within 30 days.

Q.   In the event there is property damage or a material non-compliance with the terms and conditions herein, all or part of the deposit may be forfeited. If in the event the damages exceed the deposit; USER shall immediately upon request of the OWNER, Reimburse OWNER for such damages.

R.   USER is required to purchase event insurance for the day of the event. “GFWC Woman’s Club of Homestead” must be listed as a Named Insured. Minimal limit of coverage is $1,000,000. Copy of policy must be submitted prior to entry. Suggested carrier, K & K Insurance Group, Inc. but you may obtain through another carrier.

S.   USER represents and warrants the USER is authorized to enter into this agreement and the person signing is at least 21 years old. A photo ID shall be presented.

T.   USER hereby agrees to INDEMNIFY and HOLD HARMLESS OWNER, its successors, members, board members, affiliates ETC. of all claims, demands, loss or cause of any action of any kind or nature which may arise as a result of USERS use hereunder.

U.   In the event that litigation shall arise hereunder, the prevailing party shall be entitled to recover from the other, all reasonable attorney’s fees and cost, including through the appellate level.
